WatchArtExchange (WAE)

​

WARRANTY
 
All repairwork performed by WAE has a three (3) year warranty beginning on the date that the customer receives their watch.​
Customers are responsible for contacting WAE immediately after receiving their watch at watchartexchange@gmail.com for use and maintenance of their watch and warranty.
​
This warranty does not cover: (a) damage to a watch due to accident, neglect or mistreatment; (b) the loss or theft of the watch or any damage done by loss or theft; (c) damage caused by fire, pressure, or natural disaster; or (d) damage caused by water, including, but not limited to, crystal fogginess, movement damage, dial or bezel damage, seals, gaskets, liquid penetration and any other issues pertaining to water.  In the event that the watch is not covered by the warranty, then customer will be responsible for shipping expenses and a reasonable processing fee (opening and examining the watch, testing, replacement of gaskets if necessary, etc.). 
 
Repairs, alterations, tampering, substitution and/or addition of parts, custom work and/or modification of any kind done without prior written consent from WAE and not performed by WAE will void this warranty. This warranty replaces the original manufacturers warranty.
 
All WAE warranties are non-transferable.

RETURN POLICY
​
7 Day Refund All Watch Sales.


All watches sold by WAE come with a seven (7) day return policy, provided that the watch has not been worn and is in its original condition.  Any amendment to the return period is subject to change at time of sale and must be agreed upon by both the customer and the seller in writing.


To obtain such a refund, customer must notify WAE at watchartexchange@gmail.com of such refund claim and deposit the watch with a shipping carrier and provide proof of such shipping to WAE, each within seven (7) days after customer’s receipt of the watch. All
return shipping costs and risk-of-loss will be borne by the customer.


If customer complies with each of the foregoing requirements, then WAE will issue the refund to customer within a reasonable period of time after receipt of the returned watch in the condition required hereby.

CUSTOM DUTIES & TAXES
​
Customer must pay ALL import duties, taxes, and fees, which such costs are not included in the price of the item or any shipping charges. Customer is responsible for compliance with any applicable customs and imports laws, duties, taxes, and fees for goods imported from the United States. Customer acknowledges that packages may need to clear customs and WAE does not warrant as to the length of time that may be required to clear customs.

SALES TAX
​
If sales and/or use tax is not collected at the time of purchase by WAE, you may be required to file and pay the sales and/or use tax directly to the state and/or local tax authorities for which the item was shipped to. Some states require purchasers in that state to report all non-taxed purchases of taxable items and pay tax on those purchases. For more information, we recommend that you consult with your tax advisor.

SHOP AND PAYMENT TERMS
​
We are exclusively an online company and don't allow walk-ins.


WAE is a selling platform, and only takes possession of the watch at time of sale.


WAE does not own any watches or goods on our site. All sales are subject to availability. 


Money will be refunded if product is unavailable.


Prices and terms are subject to change until time of sale.

Information contained in any quotation or listing or which are given to you by WAE’s agents or employees constitutes an invitation to treat but does not constitute an offer by WAE to supply products and/or services. All communications, including photos, are the property of WAE unless otherwise agreed upon.  All efforts will be made to keep identities private unless permission is granted.  By placing an order, you are making an offer to WAE to purchase the products and/or services.  Any order shall be subject to acceptance by WAE and WAE may decline any order in whole or in part, for any lawful reason whatsoever.  If WAE accepts your order, WAE will notify you of its acceptance by sending an order confirmation.

We limit the number of emails per customer per watch to ten (10), unless otherwise agreed upon.  Additional emails will be charged $10 per email.  This charge will be added to the customer’s final invoice. 


Payment for all repair work, whether partial or complete, is the responsibility of the customer and is due in full before WAE returns the repaired watch. The customer agrees to pay invoices within thirty (30) days after receipt. If customer fails to pay an invoice within thirty
(30) days, the customer shall pay interest on such unpaid amount at the rate of twelve percent (12%) per annum from the date of such invoice until the date payment is received by WAE.

Payment for the sale of any watch is due in full before such watch will be shipped to customer.


REPAIR TIMING; INABILITY TO MAKE REPAIRS
 

We will use reasonable efforts to complete our repairs within fourteen (14) days after receipt, but we make no guarantees or promises regarding the length of repair time. Due to the nature of the business, and the variable timeliness of various parts suppliers, we can
only provide general guidelines. By no means are these guidelines a guarantee or deadline. 


WAE is not responsible for any delays caused by the unavailability of parts or delays in part shipments by the supplier or manufacturer. Please bear in mind that companies like Omega, Rolex and Patek may take many weeks to perform repairs. WAE will return the watch to the customer within a reasonable period of time after completion of the repairs.


Certain watches may not be repairable.   If the watch cannot be repaired then the money will be refunded. If additional work or parts are needed for the repair beyond the initial estimate, then the customer will be notified.  Additional work and parts will be billed separately.  Parts and labor are sourced worldwide and guaranteed authentic.


The customer agrees to give WAE at least fourteen (14) days’ notice, in writing, to return their watch, even if not completed.


In the event that you do not want to proceed with the repairs, and do not want to pay for return shipping, WAE will hold onto your unrepaired watch for a period of no longer than one (1) year in case you change your mind regarding either the repair or return shipment.


WAE is not responsible for watches left over one (1) year.

LIMITATION ON LIABILITY


WAE’s liability for any loss of a watch by WAE or damage to a watch caused by WAE is limited to the lesser of (a) the mutually agreed-upon value of the watch before shipping to WAE and (b) $5,000, unless specifically mutually agreed upon by the customer and WAE. 
Subject to (y) the shipping terms and conditions of risk of loss as set forth herein and (z) the overall liability limit set forth in the prior sentence, in the event of loss of a watch by WAE or damage to a watch caused by WAE, WAE shall, at WAE’s discretion, either (i) replace the lost or damaged watch with one of equal value (as measured by the value of the watch before shipping to WAE) or (ii) pay the customer the agreed upon value of the watch before shipping to WAE.


WAE will promptly notify the customer in the event of any loss of or damage to a watch caused by WAE. 


Sentimental value shall not be considered when determining the value of the watch for replacement or refund purposes.


All Replica or Fake watches have a maximum value of $100.00

By using the Website, uploading content to or submitting any materials for use on the Website, you grant (or warrant that the owner of such rights has expressly granted WatchArtExchange LLC a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute such materials and/or information generated through use of the Website or incorporate such materials and/or information generated through use of the Website into any form, medium, or technology now known or later developed throughout the universe. We need these rights to host and display your content.

Please expect a newsletter from us to educate you and offer the best experience on our website.  The newsletter may include additional discounts to all of our customers and members.  You may unsubscribe from our newsletter at any time.

SHIPPING
​
Free shipping is provided by WAE Shipping Company LLC, but such shipping does not include insurance.  Shipping insurance can be provided by WAE Shipping Company LLC at customer's request and at customer’s cost and expense. The maximum amount of insurance that WAE Shipping Company LLC will provide is the lesser of (a) $5,000.00 and (b) the replacement value of the watch before shipping to WAE. Shipping insurance does not cover sentimental value. Customer must open their package and inspect it in the presence of a FedEx representative eyewitness (or any agreed upon carrier) for any claim including damage or theft and provide documentation from such individual and contact WatchArtExchange immediately.  Customer shall have the right to purchase insurance from a third party or a shipping carrier or to request that WAE Shipping Company LLC purchase such insurance at Customer’s cost and on Customer’s behalf, in any of which case Customer acknowledges and agrees that the purchase of any such insurance shall not be deemed to create or impose any liability on WAE or WAE Shipping Company LLC relating to such insurance or claims thereunder. Customer is responsible for pursuing any claims under any such insurance policy purchased by or on behalf of Customer from a third party or a shipping carrier. WAE and WAE Shipping Company LLC will reasonably cooperate in connection with Customer’s pursuit of such claim, but makes no warranties or guarantees that such claim will be successful.
 
Shipping by FedEx, USPS, UPS or any other carrier will be subject to such carrier’s terms and conditions.


Our shipping providers do not telephone prior to delivering packages, and we cannot guarantee the time of delivery. If customer is not available to receive the delivery after three attempts, the package may be returned to us, at which point customer is responsible for an
additional payment to cover re-shipment.  Shipments will be made, whenever possible, directly to a nearby FedEx facility to minimize the risk of loss.


Neither WAE nor WAE Shipping Company LLC is responsible for:
• Items delivered to incorrect addresses supplied by the sender;
• Unsuccessful deliveries arising from the recipient not being present at time of delivery at the address supplied by the sender;
• Delays in delivery due to the fault of the delivery service contracted (UPS, FedEx, etc.).


Customer remains responsible for the risk-of-loss to the watch (a) until delivery of the same to WAE (i.e., when the box or envelope is signed for and inspected by WAE) and (b) from the time that WAE deposits the watch with a recognized shipping provider. Customer is responsible for any damages that may occur to customer’s product while in transit. In the event of a claim with the shipping company, customer is responsible for pursuing such claim. WAE will reasonably cooperate in connection with customer’s pursuit of such claim,
but makes no guarantees or warranties that such claim will be successful.

 

Not responsible for watch boxes and or accompanying documentation.  Please ship watch only

Please secure watch well with bubble wrap or similar padding.​
 
THESE TERMS AND CONDITIONS ARE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH CONNECTICUT LAW, AND NO CONFLICT OF LAWS OR PROVISIONS OF ANY JURISDICTION WILL APPLY TO THESE TERMS AND CONDITIONS. BY USING THIS WEBSITE, YOU AGREE THAT ANY ACTION AT LAW OR IN EQUITY ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS WILL BE FILED ONLY IN STATE OR FEDERAL COURT LOCATED IN CONNECTICUT, AND YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY CONSENT AND SUBMIT TO THE EXCLUSIVE JURISDICTION OF SUCH COURTS OVER ANY SUIT, ACTION, OR PROCEEDING ARISING OUT OF THESE TERMS AND CONDITIONS.
